LAS VEGAS, NV (KXNT) - A woman accused along with her husband of leaving their dead baby in a dumpster is now in the custody of Immigrations and Customs Enforcement (ICE), who say she's been living in the U.S. illegally.

Adrianna Hernandez and her husband, Raul Ramos, were arrested back on January 24th, days after their 3-month old son was found in a dumpster behind an apartment complex near Las Vegas Boulevard and Carey.

The pair were arrested on suspicion of putting the newborn in a dumpster near Las Vegas Boulevard and Carey last week. They say the baby was having breathing problems and they had rolled the boy onto his side. Minutes later they say they realized that the baby had stopped breathing.

Ramos and Hernandez say they were high on methamphetamine at the time and that kept them from calling police. The pair believed that because they were high, police wouldn't have believed their story.

The pair had been released from custody last week after prosecutors asked for more time to prepare a case against the two.

Ramos and Hernandez have two other young children, who are currently being taken care of by Child Protective Services.

Hernandez is currently at the Henderson Detention Center and now faces an immigration hearing.
