Judge Tosses Out Murder Charges Against Drunk Driving Suspect

Two People, Dog Killed In November Crash

LAS VEGAS, NV (KXNT) - A judge on Thursday dismissed 2nd-degree-murder charges against a man who police say drove drunk and crashed into a sedan , killing two people and a dog.

Judge Michael Cherry dismissed the three counts against 24-year-old Aaron Kruse. Kruse still faces two counts of driving under the influence resulting in death and two counts of reckless driving.

Police say Kruse was behind the wheel the night of Novemeber 9th and slammed at a high rate of speed into the back of a Toyota that was stopped at Boulder Highway and Flamingo. 45-year-old Norma Ortiz and 49-year-old Alfonso Toxqui were killed, along with a dog that was inside the car.

The crash was one of several high-profile fatality accidents that involved alcohol. Clark County District Attorney Steve Wolfson believed that Kruse's reckless actions that night rose to the level where 2nd-degree-murder charges could be levied.
